An investigative journalist from CBS affiliate KLAS of Las Vegas started his own investigation of improper foreclosure practices. As known, Las Vegas is one of the hardest hit areas in the foreclosure crisis, which seeded foreclosure fraud.
George Knapp, a chief investigative reporter was doing his investigation to bring into light the situation of tens of thousands of distressed homeowners. As he learned during his investigation, thousands of homeowners, who paid their monthly mortgage on time, had to face the aching truth that they don’t own the home they are living in, due to fraudulent paperwork.
After listening to the troubled homeowners’ stories, the reporter contacted a foreclosure defense lawyer to find out the options allowed by law. The foreclosure attorney, Trisha Black informed him that in Las Vegas nine out of ten foreclosure filing are fraudulent, and jeopardize the ownership status of the house.
After his interview with Trisha Black, George Knapp gave the attorney his address, because he also bought his home out of foreclosure a couple years before. He was shocked to find out, that he faces the situation of the people who’s cases he investigates.
Furthermore the Attorney General’s office confirmed that the reporter is not the rightful owner of the house, although he is current on his mortgage, due to improper filings and bogus signatures that cloud the house title.
According to George Knapp, the main source of the foreclosure fraud is MERS. The system was created by banks in the mid 90s to avoid the procedure that involved the County Clerk’s office. As a result of the mortgage laundering system named MERS, the banks have managed to cloud the title ownership of the property and they can foreclose on the properties in the name of MERS. The only problem is that the documents are taken under the loop, the fraudulent activity becomes obvious. But the most terrifying fact is, that Knapp could not find anybody to guide him out from this mess created by banks.
